User Agreement and Terms of Use of the SoloWay Studio website

1. General provisions

These Terms of Use (hereinafter **"Terms") govern access to and use of the soloway.studio website.

The operator of the Site is SoloWay Studio. For all questions regarding the use of the Site, you can contact contact.solowaystudio@gmail.com.

In these Terms, the words "SoloWay Studio", "SoloWay", "we", "us" and "our" mean the operator of the Site, and the words "user" and "you" mean any person who visits or uses the Site.

By accessing or using the Site, as well as by creating an account, you confirm that you have read these Terms and agree to be bound by them. If you do not agree to the Terms, do not use the Site or create an account.

These Terms are not a public offer for a paid subscription, purchase of content or provision of paid access. In its current version, the Site does not sell subscriptions and does not charge for viewing the catalog.

2. What is the Site

SoloWay Studio creates a catalog of animated and other audiovisual works that have official Ukrainian dubbing or localization, created in agreement with the authors or rights holders.

The following may be available on the Site:

pages of works with titles, descriptions, posters and other information;
original production credits and Ukrainian localization credits;
embedded videos from the official YouTube channels of authors or rights holders;
links to official resources and author support services;
user accounts;
comments, ratings and likes;
bookmarks, viewing lists and saving progress;
search, filters, recommendations and thematic selections;
forms for applications and proposals for cooperation;
buttons for voluntarily supporting SoloWay Studio.

Video files embedded from YouTube are not uploaded to the SoloWay Studio server and are not stored there. Their availability, playback, advertising, statistics and monetization depend on YouTube, the video creator and the respective channel settings.

3. Access and Accounts

Viewing the main content of the Site is free and does not require registration. An account may be required to comment, rate, sync bookmarks, lists, or progress.

By creating an account, you confirm that:

you are 16 years old;
you provided a current email address;
do not impersonate another person or organization;
create an account for yourself or have the appropriate authority to act on behalf of the organization;
you will keep the password secret and will not give access to other persons.

You are responsible for actions taken through your account unless you notify SoloWay of unauthorized access.

In case of suspicion of hacking, loss of password or third-party access, write to contact.solowaystudio@gmail.com.

The User may stop using the Site and request account deletion. The handling of associated data after deletion is described in Privacy Policy.

We may temporarily limit or terminate access to the account if the user materially or repeatedly violates these Terms, the law, the rights of others, or poses a threat to the security of the Site.

4. Changes and availability of the Site

We may change the structure, design, and functionality of the Site, add, update, temporarily hide or remove pages and materials, and suspend the Site for maintenance, security, or compliance with legal requirements.

We strive to ensure stable operation of the Site, but do not guarantee its continuous or error-free availability at all times.

5. Intellectual property

5.1. SoloWay Studio materials

Unless otherwise expressly stated, the rights to the SoloWay Studio name and visual identity, the structure and design of the Site, texts created by SoloWay, Ukrainian descriptions, graphic elements, materials about the studio's work and other original components of the Site belong to SoloWay Studio or are used by it on a lawful basis.

Rights to Ukrainian translations, adaptations, dubbing, soundtracks and other results of SoloWay's work are determined by legislation and relevant agreements with authors, customers and rights holders.

5.2. Original works and materials of the authors

Copyright and other rights to original works, characters, videos, music, posters, logos, footage and other materials belong to their respective authors, rights holders or licensees.

Placing a work in the catalog does not mean the transfer of copyright or ownership rights to SoloWay Studio. Such materials are used based on permission, contract, functionality of the relevant platform or other legal basis.

Third-party names, pseudonyms, logos, and trademarks are used for proper attribution and identification of the respective works and copyright holders.

5.3. Embedded YouTube videos

Embedded videos remain part of the YouTube service and are played through its official player. Use of the player and video is also governed by the YouTube Terms of Use and the rules of the applicable rights holder.

The presence of a video on the SoloWay page does not grant the user the right to download, copy, republish, modify, sell, publicly display or otherwise use it outside the functions permitted by YouTube, the copyright holder and the law.

6. Permitted Use

You can:

view publicly available pages and materials for personal non-commercial purposes;
create an account for bona fide personal use;
use search, filters, recommendations, players and profile functions;
create bookmarks and viewing lists;
leave honest comments, evaluations and reactions;
follow the official links of the authors and SoloWay Studio;
distribute a regular link to the Site page;
quote small fragments of the text within the limits allowed by law, indicating the source and an active link.

Any other use of the materials requires the permission of the respective copyright holder, unless expressly permitted by law.

7. Comments, Ratings, and Other User Content

The user retains the rights to the text, images and other materials that he independently publishes on the Site.

By posting a comment or other content, the user grants SoloWay Studio a non-exclusive, royalty-free license to store, technically reproduce, display and format it within the scope of the Site, as well as to moderate it in accordance with these Terms.

User Content must not:

violate copyright, related, personal non-property, private or other rights;
contain illegal materials, threats, harassment, hate speech or discrimination;
contain spam, hidden advertising, fraudulent links or malicious code;
disclose someone else's personal or confidential data without a legal basis;
give false information about the official position of SoloWay, the author or the right holder;
deliberately spoiling the discussion with mass spoilers, repeated messages or other abuses.

We may hide, edit for technical formatting, anonymize, or remove User Content if it violates these Terms, the law, or the rights of others.

Ratings, reactions and comments reflect the opinions of users and do not represent the official position of SoloWay Studio. It is forbidden to manipulate ratings, reactions or statistics using bots, mass accounts, purchased activity or other artificial methods.

After account deletion, comments may be deleted or anonymized to preserve the structure of the discussion.

8. Prohibited Use

When using the Site, it is prohibited to:

violate the law, the rights of SoloWay Studio, authors, copyright holders or other persons;
copy, download, repost, sell, license or commercially use materials without proper permission;
remove or change credits, designations of authorship, rights holders or sources;
circumvent technical restrictions, protective mechanisms or rules of operation of built-in services;
interfere with the operation of the Site, servers or administrative panel;
attempt to gain unauthorized access or test vulnerabilities without prior written permission;
distribute malicious code, spam or create excessive load;
use automated means for mass collection of materials or data, except for standard indexing by public search engines;
impersonate another person, author, right holder or representative of the organization;
send false information about rights to the work or authorization;
bypass blocking or restrictions using new accounts;
use the Site for threats, harassment, discrimination, illegal content or other abuses.

9. Address of the authors and proposals for cooperation

Sending an application or materials through a form or e-mail:

does not create an automatic obligation for SoloWay to respond, accept the project, perform dubbing or publish the work;
is not an automatic conclusion of a contract;
does not transfer copyright or the right to publicly use the sent materials to SoloWay;
grants SoloWay the right to receive, open, internally review and evaluate the materials to the extent necessary to consider the submission and respond to it.

By submitting materials, you represent that you have the right to submit them and that SoloWay's internal review of them does not infringe the rights of others.

Creation of dubbing, publication of the work, use of promotional materials in advertising, paid distribution or other collaboration is agreed separately. If necessary, the parties conclude a separate contract or fix the scope of the permit in writing.

Do not send trade secrets or embargoed material without first agreeing to a privacy policy. The very fact of receipt of materials does not create an obligation of non-disclosure, unless such an obligation is provided for by law or a separate agreement.

10. External services and links

The Site may contain embedded content and links to YouTube, Patreon, social networks, author sites, payment systems and other third-party resources.

These services operate independently of SoloWay Studio and have their own terms and policies. SoloWay has no control over their availability, rules, content, prices, payment methods or data processing.

The transition to a third-party site and the use of its services are carried out at the user's discretion.

11. Support for authors and SoloWay Studio

The author support button leads to an external resource identified by the respective author or rights holder. Unless expressly stated otherwise, SoloWay is not a party to the relationship between the user and the author, and does not accept or distribute this payment.

The SoloWay Studio support button can lead to an external payment or crowdfunding service. Such support is voluntary and, unless expressly stated otherwise, does not constitute payment for a specific product, subscription, viewing rights, or guaranteed result.

The payment is processed by a third-party service according to its rules. SoloWay does not receive full bank card details if the payment is made entirely on a third-party platform.

12. Accuracy of Information and Credits

We strive to provide accurate titles, descriptions, credits, references, age categories, and other information, but do not guarantee that all information is error-free or complete.

Age ratings and genre descriptions are for informational purposes only and are not a substitute for parental or legal guardians' decisions regarding content viewing by minors.

13. Infringement Notification

If you believe that material on the Site infringes your rights, send a message to contact.solowaystudio@gmail.com and indicate:

your name, contact details and, if applicable, organization;
the material or page concerned by the notice;
a link to the relevant page;
a description of the right that, in your opinion, has been violated;
confirmation that you are the right holder or authorized to act on his behalf;
preferred method of solving the situation;
confirmation of good faith and reliability of the provided information.

We may request additional information, temporarily restrict access to the disputed material pending review, correct it, or remove it if there is sufficient reason to do so.

If the notice concerns the YouTube video itself rather than information on the Site, the user may also contact the channel owner or use YouTube's reporting mechanisms.

14. Disclaimer of Certain Warranties

The site and information materials are provided in the form available at the relevant time. To the extent permitted by law, we do not provide additional guarantees regarding uninterrupted availability, permanent availability of third-party video, compliance of materials with individual expectations, or error-free operation of external services.

We do not guarantee that a work available today on YouTube or any other resource will remain available in the future. The author, rights holder or platform may change the settings, limit the viewing area or remove the material.

15. Limitation of Liability

To the extent permitted by law, SoloWay Studio is not responsible for:

actions, conditions, content or technical failures of third-party services;
temporary unavailability of the Site or material due to technical reasons or reasons beyond SoloWay's control;
user comments, ratings and other content until SoloWay has received proper notice and had a reasonable opportunity to respond;
user decisions made on the basis of information from third-party resources;
losses caused by the user's violation of these Terms, legislation or rules of a third-party platform;
unauthorized actions of third parties that could not reasonably have been prevented by adequate security measures.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law.

16. Privacy and Cookies

Processing of personal data is described in Privacy Policy.

The use of cookies and local storage is described in Cookie Policy.

17. Changes to the Terms

We may update these Terms due to changes in functionality, legislation, operating model or composition of external services.

The current version is published on this page with the date of the update. If the changes materially affect users with accounts, we may provide additional notice on the Site or by email.

Continuation of use of the Site after the entry into force of the new version means acceptance of the updated Terms. If the user does not agree with the changes, he can stop using the Site and request the deletion of his account.

18. Governing Law and Dispute Resolution

These Terms are governed by the legislation of Ukraine, in particular the provisions of the Civil Code of Ukraine and the Law of Ukraine "On Copyright and Related Rights".

Before going to court, the parties will, where possible, try to resolve the dispute through negotiations and written correspondence.

If it was not possible to reach an agreement, the dispute is resolved by a competent court in accordance with the rules of jurisdiction. The mandatory rights of users remain in effect regardless of the provisions of these Terms.

19. Other provisions

If any provision is held to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.

SoloWay's failure to exercise a particular right or method of protection does not constitute a waiver thereof.

These Terms do not create an employment, agency, partnership or joint business relationship between SoloWay and the user.

In the event of translations in other languages, the Ukrainian version shall prevail, unless otherwise expressly provided by law.
